Precon Insurance Solutions (“Precon,” “we,” “us,” or “our”) operates the Precon Surety platform and related websites and applications (collectively, the “Platform”). This Privacy Policy describes how we collect, use, disclose, and protect information when you access or use the Platform, create an account, complete pre-qualification, request bonds or insurance, or otherwise interact with us.

By creating an account or using the Platform, you acknowledge that you have read and understood this Privacy Policy. This Policy should be read together with our Terms of Service.

We collect information in the following categories:

A. Information You Provide to Us

• Account and contact information (name, email address, phone number, company name, job title, mailing address)

• Business and financial information submitted during pre-qualification or underwriting (financial statements, work-in-progress schedules, bank information, ownership details, experience questionnaires, and related documents)

• Project and bond request information (project name, location, contract amount, obligee details, bid dates, and related data)

• Communications you send to us (support requests, emails, and other correspondence)

B. Information Collected Automatically

• Device and usage data (IP address, browser type, operating system, pages viewed, time spent, referring URLs, and similar technical information)

• Cookies, pixels, and similar technologies that help us operate, secure, and improve the Platform

C. Information from Third Parties

• Public records, credit or financial information services, and industry data sources used in underwriting and risk assessment

• Information from carriers, MGAs, wholesale brokers, or other market participants in connection with quotes, placement, or servicing

3. How We Use Information

We use the information we collect to:

• Provide, operate, and improve the Platform and our Services

• Create and manage your account and pre-qualification profile

• Process bond and insurance requests, obtain quotes, and place coverage

• Communicate with you about your account, requests, products, and Platform updates

• Perform underwriting support, risk assessment, and compliance checks

• Detect, prevent, and address fraud, security issues, and technical problems

• Comply with legal, regulatory, and contractual obligations

• Analyze usage trends to improve the Platform and user experience

4. How We Share Information

We share information in the following circumstances:

A. Market Participants (Carriers, MGAs, and Wholesale Partners)

In order to obtain quotes, underwrite risks, and place bonds or insurance, we share relevant application, financial, project, and company information with carriers, managing general agents (MGAs), wholesale brokers, surplus lines brokers, and other authorized market participants in our distribution network. This sharing is essential to the Services and is authorized under our Terms of Service.

B. Service Providers

We may share information with trusted third-party service providers that assist us with technology infrastructure, data hosting, analytics, communication, identity verification, and similar operational functions. These providers are contractually obligated to protect the information and use it only for the purposes we specify.

C. Legal and Compliance

We may disclose information if required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect the rights, property, or safety of Precon, our users, or others, or to enforce our agreements.

D. Business Transfers

In connection with a merger, acquisition, reorganization, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to standard confidentiality protections.

E. With Your Direction or Consent

We may share information when you direct us to do so or when you otherwise provide consent.

We retain information for as long as necessary to provide the Services, maintain your account and pre-qualification profile, comply with legal and regulatory obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the nature of the information and applicable requirements. When information is no longer needed, we take steps to delete or de-identify it.

We implement reasonable administrative, technical, and physical safeguards designed to protect the information we maintain. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

8. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information. California residents have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), subject to applicable exceptions:

Sharing of information with carriers, MGAs, and wholesale partners for the purpose of obtaining quotes and placing coverage is performed as a service provider / business purpose necessary to provide the Services you request.

Authorized agents may submit requests on behalf of California residents subject to verification requirements.

9. Children’s Privacy

The Platform is intended for business users and is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected information from a child, we will take steps to delete it.

10. Third-Party Links and Services

The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated” date at the top indicates the most recent version. Material changes will be posted on the Platform or otherwise communicated to you. Your continued use of the Platform after the last updated date of changes constitutes acceptance of the updated Policy.
