Agreement to These Terms
These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “your,” or “User”) and Precon Insurance Solutions (“Precon,” “we,” “us,” or “our”) governing your access to and use of the Precon Surety platform, websites (including preconinsurance.com and app.preconsurety.com), applications, and all related services (collectively, the “Platform” or “Services”).
BY CREATING AN ACCOUNT, ACCESSING ANY PORTION OF THE PLATFORM, COMPLETING PRE-QUALIFICATION, SUBMITTING ANY REQUEST, OR OTHERWISE USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE ENTIRE TERMS. This agreement applies fully whether or not you ever request, order, or obtain a bond or insurance policy through the Platform. Account creation constitutes acceptance of all provisions, including those relating to data sharing, market placement, intellectual property, limitations of liability, indemnification, and dispute resolution.
If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have full authority to bind that entity to these Terms. If you do not agree to these Terms, you must not create an account or use the Platform.
1. About Precon Surety
Precon Surety is the contractor-focused digital platform operated by Precon Insurance Solutions, a licensed California insurance broker. We modernize and simplify access to surety bonds and construction-related insurance through a lean, distribution-driven model that combines technology, automated workflows, and professional placement into wholesale and carrier markets.
Our Services include facilitation of:
• Bid bonds, performance bonds, payment bonds, maintenance bonds, warranty bonds, contractor license bonds, permit bonds, and related surety products
We integrate live public-works project data to support faster, more informed bond requests. Precon is not the surety and is not the insurer. Any bond or policy is issued solely by the authorized carrier or surety company that accepts the risk. Precon acts solely as a licensed insurance broker and technology platform.
2. Eligibility and Account Registration
You must be at least 18 years of age and authorized to act on behalf of a legitimate construction-related business. By creating an account you agree to provide accurate, current, and complete information during registration, pre-qualification, and any subsequent requests. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
These Terms apply in full to every registered user, including users who only browse the live project inventory, complete pre-qualification, or never submit a bond or insurance request. We reserve the right to refuse, suspend, or terminate any account or access at our sole discretion.
3. Description of Services and Authorization for Market Placement
The Platform enables digital pre-qualification, application submission, underwriting coordination, access to live project information, and ordering of bonds and insurance. Once pre-qualified, eligible users may submit requests that can be fulfilled rapidly through our processes.
Authorization for Placement. By creating an account and using the Services, you expressly and irrevocably authorize Precon Insurance Solutions and its affiliates to:
• Collect, review, store, and transmit your application materials, financial information, project details, company data, and related information;
• Submit applications and obtain quotes from, and place coverage or bonds with, any carriers, managing general agents (MGAs), wholesale brokers, surplus lines brokers, or other authorized market participants in our distribution network; and
• Select and route submissions based on our professional judgment regarding capacity, terms, speed, underwriting appetite, and overall fit for the risk.
This authorization applies to any and all requests (present or future) submitted through your account. Our network of market participants is dynamic. Available carriers, MGAs, and wholesale partners may change over time as we expand capacity, optimize placement, or respond to market conditions. You agree that placement decisions rest exclusively with Precon and that we have no obligation to use any specific market participant for any particular request.
You acknowledge that final underwriting, pricing, terms, conditions, and issuance decisions rest solely with the carrier or surety. Precon does not guarantee that any bond or policy will be issued, that any particular rate or terms will be available, or that capacity will remain unchanged.
4. User Responsibilities
You agree to:
• Provide complete, accurate, and truthful information and promptly update any material changes;
• Ensure that all individuals accessing the Platform under your account are authorized to do so;
• Comply with all applicable laws, licensing requirements, and project-specific bonding or insurance obligations;
• Use the Platform only for legitimate business purposes related to construction risk management; and
• Not attempt to reverse-engineer, scrape, copy, or interfere with the Platform, its data sources, or security features.
5. Fees, Premiums, and Payments
Any premiums, bond premiums, or fees are charged by the issuing carrier or surety according to their filed rates and underwriting guidelines. Precon may earn commissions or fees in connection with placement. You are responsible for timely payment of all amounts due under any bond or policy. Failure to pay may result in cancellation or other remedies in accordance with the applicable bond or policy form and applicable law.
6. Intellectual Property and Platform Content
The Platform, including its software, design, live project inventory features, data compilations, trademarks, logos, and all content, is owned by Precon Insurance Solutions or its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your internal business purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works of any portion of the Platform without our prior written consent.
7. Privacy
Our collection, use, and sharing of personal and business information is governed by our Privacy Policy (available on the Platform). By creating an account or using the Services you consent to the practices described in the Privacy Policy, including the sharing of information with carriers, MGAs, wholesale partners, and other market participants as necessary to provide quotes, underwrite risks, and place coverage.
8. Disclaimers
THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRECON INSURANCE SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components, or that any particular bond or insurance product will be available or issued. Live project data is provided for convenience only and may contain inaccuracies or omissions; you remain solely responsible for verifying all project requirements and information.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRECON INSURANCE SOLUTIONS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES (IF ANY) ACTUALLY PAID BY YOU TO PRECON IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations of liability; in such cases the above limitations apply to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Precon Insurance Solutions and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Platform or Services; (b) any inaccurate, incomplete, or misleading information you provide; (c) your violation of these Terms or any applicable law; or (d) any claim by a third party related to a bond or policy obtained or requested through the Platform.
11. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause or prior notice. You may stop using the Services at any time by discontinuing access. Provisions that by their nature should survive termination (including Sections 6, 8, 9, 10, 12, and 13) will survive any termination or expiration of these Terms.
12. Modifications to These Terms
We may update these Terms from time to time. The “Effective Date” at the top of this document will indicate the most recent version. Material changes will be posted on the Platform or otherwise communicated to you. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall be conducted in Riverside County, California (or remotely by video if mutually agreed). You and Precon each waive any right to a jury trial and any right to participate in a class-action lawsuit or class-wide arbitration. Either party may seek provisional injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information pending the outcome of arbitration. Judgment on the arbitration award may be entered in any court having jurisdiction.
Notwithstanding the foregoing, either party may bring an individual action in small-claims court if the claim qualifies.
14. Miscellaneous
These Terms, together with our Privacy Policy and any additional terms presented at the time of a specific request, constitute the entire agreement between you and Precon Insurance Solutions regarding the Services and supersede all prior or contemporaneous agreements, representations, and understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms freely without restriction.
Headings are for convenience only and do not affect interpretation. These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Precon beyond the limited broker relationship described herein.
